Texas Adoption Law: Rights and Choices
- Consent in Texas is signed no sooner than 48 hours after birth.
- You choose the family and openness; before signing, you can change your plan. After signing, revocation is very limited so it is critical to make sure you are 100% in favor of placement before signing.
- Texas birth fathers are notified of possible paternity and the adoption plan if they can be located using reasonable efforts. If not, the Texas putative father registry is checked. If a birth father has not registered with the State and his whereabouts are unknown, his rights to stop the adoption can be terminated without notice to him.
- Help with living expenses such as rent, utilities, food, maternity clothing, transportation, and phone are permissible in Texas as long as they are distributed to you by an agency, like ours, that is fully licensed by Texas to make adoption placements.
- Open or closed contact is your choice; while written post-adoption contact agreements may not be legally enforceable in Texas, if you select a family outside of Texas, an enforceable agreement typically can be made.
- Interstate placements use ICPC (state-to-state approval) to ensure both states clear placement before the baby leaves Texas with the family.

Texas Adoption FAQs
Is adoption free for birth mothers?
Yes. You do not pay for:
- Your adoption attorney
- Counseling / emotional support
- Adoption planning support
- Pregnancy-related costs when legally allowed and approved
How long does adoption take in Texas?
You can make an adoption plan any time before or after delivery and matching with a family can take place as fast as you would like.
What’s open versus closed adoption?
Open adoption: you and the adoptive family agree to specific contact, such as photos/updates monthly or quarterly, phone/video calls 1-4 times per year, in-person visits 0-2 times per year (only if you want).
Closed adoption: no ongoing contact and identifying info is kept private.
You can also choose something in-between (often called semi-open).
How do I choose a family?
You choose from families who are already home-study approved, background checked, and financially verified (able to adopt). You can review profiles, request a call/meeting, and say no to any family without explaining why.
What about the birth father?
Texas requires legal steps depending on the situation. Typically, if he’s known, the attorney will notify him and/or obtain consent. If he’s unknown or his whereabouts are unknown, Texas uses a Putative Father Registry. The adoption attorney typically handles this process and will explain exactly what applies to your case.
What is ICPC?
ICPC is required when the adoptive family lives in another state. It’s a legal clearance before the baby can cross state lines, and typically takes about 3-5 days (can be shorter or longer). The adoptive family will stay in Texas with the baby until Texas ICPC approves.
We coordinate the paperwork between both states.
