Texas Adoption Law: Rights and Choices
- Consent in Texas is signed no sooner than 48 hours after birth.
- You choose the family and openness; before signing, you can change your plan. After signing, revocation is very limited so it is critical to make sure you are 100% in favor of placement before signing.
- Texas birth fathers are notified of possible paternity and the adoption plan if they can be located using reasonable efforts. If not, the Texas putative father registry is checked. If a birth father has not registered with the State and his whereabouts are unknown, his rights to stop the adoption can be terminated without notice to him.
- Help with living expenses such as rent, utilities, food, maternity clothing, transportation, and phone are permissible in Texas as long as they are distributed to you by an agency, like ours, that is fully licensed by Texas to make adoption placements.
- Open or closed contact is your choice; while written post-adoption contact agreements may not be legally enforceable in Texas, if you select a family outside of Texas, an enforceable agreement typically can be made.
- Interstate placements use ICPC (state-to-state approval) to ensure both states clear placement before the baby leaves Texas with the family.
